PREAMBLE

These General Terms and Conditions of Sale (hereinafter referred to as "GTC") are concluded exclusively between (1) any person making a purchase on the website www.histoiresderoseau.com (hereinafter referred to as the "Customer") and (2) the company HISTOIRES DE ROSEAU, SAS with a share capital of 54,000 euros and having its registered office at ZI les Taillas, 43600 Sainte Sigolène (France), SIRET number: 498 196 708 00032 RCS Le Puy en Velay.

The Customer hereby formally declares that they are a natural person, of legal age or with parental authorization, and have full legal capacity to enter into a contract and place an order online on the website www.histoiresderoseau.com (hereinafter, "the HistoiresdeRoseau® website"). These terms and conditions of sale apply exclusively to persons aged 18 and over. Customer account creation is reserved for natural persons aged 18 and over.
The Customer and HistoiresdeRoseau® jointly agree that their relationship is governed exclusively by these General Terms and Conditions of Sale. In this regard, the Customer acknowledges that any order validated by "double-clicking" implies irrevocable acceptance of these General Terms and Conditions of Sale.
This validation by the Customer, combined with the authentication and non-repudiation procedures and the protection of message integrity, constitutes the unequivocal expression of the Parties' intent, who are thus deemed signatories to the distance selling agreement. HistoiresdeRoseau® reserves the right to adapt or modify these General Terms and Conditions of Sale at any time.
Each order will be deemed to have been placed according to the Terms and Conditions in effect on the date it is placed on the HistoiresdeRoseau® website, the date the Terms and Conditions are published online being considered the effective date. For any questions relating to an online purchase, the Customer can contact HistoiresdeRoseau® Customer Service:
- Either directly on the website, via the contact forms by accessing your account in the "My Account" section
- Either by telephone, at 06 70 69 80 78 (cost of a normal call) from Monday to Friday from 2pm to 5pm

ARTICLE 1. ORDER VALIDATION ON THE HISTOIRESDEROSEAU.COM WEBSITE

To place an order on the HistoiresdeRoseau® website, the customer will be guided through the following steps:
• Selection of products available on the site in the "Shopping Cart",
• Choice of delivery method for the products displayed in the "shopping cart",
• Presentation of the order summary, which can be modified, and its total price
• Payment method validation,
• Sending an order validation email to the Customer confirming their registration after acceptance of their payment.
The order confirmation email sent to the Customer confirms HistoiresdeRoseau®'s acceptance of the customer's order, and confirms the formation of the sales contract between the parties.


ARTICLE 2. VALIDITY OF OFFERS - AVAILABILITY OF PRODUCTS

Products displayed on the HistoiresdeRoseau® website at any given time are generally considered to be in stock at that time, except for limited-time offers as part of a specific promotion, which will be expressly indicated as such on the product page. This initial availability is verified after the order has been accepted for payment and is confirmed by the shipping confirmation email sent by HistoiresdeRoseau®.
In the event that one or more products are unavailable, HistoiresdeRoseau® undertakes either to offer the Customer a new delivery date for the ordered product(s) or to refund them by crediting the payment method used for the purchase, within 14 calendar days of the order payment. If a technical event prevents the crediting of the payment method used, HistoiresdeRoseau® will offer the Customer the option of issuing a bank check made payable to them and mailing it to the billing address provided. Product and price offers are deemed to be those displayed at checkout, represented by the "CART" page of the HistoiresdeRoseau® website. Therefore, only the price indicated on this page, corresponding to the price charged to the Customer at the time of their order, is valid and contractually binding on HistoiresdeRoseau®.
Therefore, any typographical error on any other page that may occur on graphic and/or promotional elements within the site cannot engage the responsibility of HistoiresdeRoseau®.


ARTICLE 3. PRICE

The prices displayed on the HistoiresdeRoseau® website are expressed in euros (€) and are understood to be public prices including all charges as they may be applicable in metropolitan France on the date of consultation of said offers.
The applicable VAT rate is that in effect on the date the order is placed. Specific taxes, other than VAT, which may be applied according to regulations (such as furniture eco-tax or eco-tax participation), are only indicated on the product page and the shopping cart page, the latter being the only page that is legally binding, as stated in the last paragraph of Article 2 above. All product prices displayed on the HistoiresdeRoseau® website exclude shipping, assembly, and any other ancillary services.
They only include the price of the product itself, as described, and its packaging. HistoiresdeRoseau® reserves the right to change its prices at any time but is committed to applying the prices displayed at the time the order is placed, subject to availability on that date.
The products remain the property of HistoiresdeRoseau® until full payment of the price has been received by the latter.


ARTICLE 4: PAYMENT 4.1 PAYMENT METHODS

Regardless of the payment method chosen from those accepted on our site, orders will only be considered registered after payment has been validated or received. Therefore, until payment is validated by the intermediary chosen by the consumer, the order cannot be processed by HistoiresdeRoseau®. Payment can be made using the following bank cards: Carte Bleue, VISA, MASTERCARD.

The Customer can consult the General Terms and Conditions of Sale and Use for each of these bank cards on our partners' websites. Choosing one of these payment cards constitutes tacit acceptance of the general terms and conditions of sale and use of said partners. We encourage our customers to review them, as HistoiresdeRoseau® cannot be held responsible for the conditions set by these independent partners. Online payment by bank card is completely secure and allows you to confidently enter the card number, expiry date, and security code in the designated fields. Indeed, credit card details are encrypted using the SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network.

Payment is made directly to the bank. HistoiresdeRoseau® has no access to this information and cannot store it on its servers. This is why you are asked to provide it again for each new transaction on our site.

4.2 COMBATING FRAUD
HistoiresdeRoseau® reserves the right to verify the validity of the payment, before shipping the order, by any means it deems necessary (including identity documents, proof of address, etc.).

4.3 PAYMENT INCIDENT
HistoiresdeRoseau® reserves the right to refuse to make a delivery or fulfill an order for which a payment dispute is pending. In the event of fraud, HistoiresdeRoseau® reserves the right to remove any member without prior notice or compensation.


ARTICLE 5: DELIVERY 5.1 ORDER PREPARATION TIMES

HistoiresdeRoseau® reserves the right to subcontract all or part of the order preparation and shipping to a third party authorized to perform this service. As all products sold by HistoiresdeRoseau® are considered to be in stock, orders are prepared within 48 business hours from the first business day following order registration as defined in these Terms and Conditions.
Orders placed on a Saturday, Sunday, or public holiday will be processed on the next business day. This timeframe does not include the time required to schedule a delivery appointment with the carrier or the carrier's actual delivery time. All delivery times mentioned on the HistoiresdeRoseau® website are defined as clear days. The ordered product is delivered to the address indicated on the order form and registered as the "delivery" address.
In the event of an input error, in particular an incorrect or incomplete delivery address, HistoiresdeRoseau® cannot be held responsible for the consequences in terms of delay or impossibility of delivery.

All costs related to the reshipment of products following a data entry error by the Customer will be borne exclusively by the Customer.

5.2 ORDER DELIVERY TIMES
HistoiresdeRoseau® reserves the right to choose the most suitable shipping method based on the nature, weight, and volume of the product, which the Customer acknowledges having read and accepted. Delivery times will not exceed 30 business days from the date the Customer's payment is validated (order registration date).
Delivery times cannot be guaranteed in cases of force majeure, as defined by law and case law. Delivery times do not take into account any payment verification procedures that may delay the shipment of the Customer's order (see provisions of article 4.2).
The stated delivery times begin from the date the order is registered. The estimated delivery date is indicated on the order confirmation and on each of our product pages. This timeframe is an average delivery time for the service used for delivery within mainland France.

In the event of absence, the Customer will be responsible for collecting the product from the relevant service provider. When the product is to be delivered by carrier to the delivery address provided by the Customer, the Customer specifies the availability window when placing the order. The carrier will then contact the Customer as soon as possible to arrange a delivery appointment. HistoiresdeRoseau® cannot be held responsible for delivery delays due to the Customer's unavailability.

5.3 DELIVERY AREAS
Delivery is only available in Metropolitan France (excluding overseas territories).

5.4 SPECIAL DELIVERY TERMS
The delivery methods for HistoiresdeRoseau® products are determined by HistoiresdeRoseau® and depend on their eligibility for postal shipping. When a product is eligible for postal shipping, the Customer will have the option of choosing between in-store pickup or home delivery via DPD or Colissimo. After confirming these shipping options, the HistoiresdeRoseau® website will display an order summary including shipping costs. The cost of the selected shipping method will then be displayed before the order is processed for payment.

Once the order has been prepared and is ready for shipment, the Customer will receive an email regarding the dispatch of their order. Delivery via Colissimo: Delivery via Colissimo is a service offered by the French postal service and is subject to its own General Terms and Conditions of Use. If the Customer is absent and it is impossible to leave the package with a concierge, they will receive a delivery notice. They will then have 14 calendar days to collect their package from the post office indicated on the notice.

Otherwise, the order will be shipped to HistoiresdeRoseau®, who will contact the Customer by email to resend the order at their expense. If the Customer does not respond within 7 days of this reminder email, HistoiresdeRoseau® will consider that the Customer has exercised their right of return and will issue a refund under the conditions stipulated for exercising the right of withdrawal (see Article 6-1 of these Terms and Conditions).

5.5 DELIVERY RATES
Shipping costs are calculated based on a formula that takes into account both the destination and the weight of the package. All prices shown are in euros (€), inclusive of all taxes and charges, including VAT at the rate in effect on the day of delivery. The shipping cost is automatically calculated when a product is added to your cart, based on delivery within mainland France.
The Customer can freely consult the invoice and the carrier associated with their products. Specific offers for free shipping are valid only for shipments within mainland France, unless expressly stated otherwise.


ARTICLE 6: RIGHT OF WITHDRAWAL

6.1. CONDITIONS FOR EXERCISING THE RIGHT OF WITHDRAWAL
In accordance with Article L. 221-18 of the French Consumer Code, the Customer has 14 calendar days to exercise their right of withdrawal, without needing to provide any justification. This period begins the day after the order is received. For orders of several goods delivered separately, or for orders of goods consisting of multiple lots or parts whose delivery is staggered over a defined period, the period begins upon receipt of the last good, lot, or part. For contracts providing for the regular delivery of goods over a defined period, the period begins upon receipt of the first good. To exercise their right of withdrawal, the Customer must inform HistoiresdeRoseau® of their decision by sending a letter or email, before the expiry of the aforementioned 14-day period, stating their intention to withdraw. To exercise this right of withdrawal, the returned product must be in a condition that allows for its immediate resale. The product must therefore be returned in new condition, with all instructions and accessories included, and in its original packaging. HistoiresdeRoseau® reserves the right to refuse a refund if all of these conditions are not met. Return shipping costs are the responsibility of the customer. If the right of withdrawal is exercised within the aforementioned period, and in accordance with the provisions of Article L.221-24 of the French Consumer Code, HistoiresdeRoseau® will reimburse the customer for the price of the returned product(s) as well as the original shipping costs within 14 calendar days from the date on which it was informed of the customer's decision to withdraw. HistoiresdeRoseau® reserves the right to postpone reimbursement until the goods are received or until the Customer provides proof of shipment, whichever occurs first. Reimbursement will always be based on the amounts actually paid by the Customer, as shown on their invoice. However, HistoiresdeRoseau® reserves the right to refuse to reimburse any additional delivery costs incurred due to a more expensive delivery method expressly chosen by the Customer when HistoiresdeRoseau® had offered a standard delivery option.
The shipping costs to be reimbursed will be calculated as if the Customer had never purchased the returned product(s). Finally, as a general rule and unless otherwise expressly requested by the Customer, HistoiresdeRoseau® will issue the refund by crediting the original payment method. Return shipping costs are expressly the responsibility of the Customer, who acknowledges and accepts this by agreeing to these General Terms and Conditions of Sale.

6.2. PRODUCT RETURN PROCEDURES

Return policy

At Histoires de Roseau, we are committed to offering you quality products and impeccable service. However, if you are not completely satisfied with your purchase, you can return the items in accordance with our return policy described below.

Return Policy: You have 14 days from the date of receipt of your order to return your items. After this period, we unfortunately cannot accept returns.

Product Condition: Returned products must be in perfect condition, undamaged, unused, and in their original packaging. Any returned item that is damaged, soiled, or incomplete will not be refunded.

Return Shipping Costs: Return shipping costs are the responsibility of the customer. You can choose your preferred carrier to return the items to us.

Return Procedure:

  1. Return Request: Please visit our website and access the "Product Return" tab at the bottom of the page to make your return request.
  2. Notify our Customer Service: After making your return request, please send an email to our customer service at [Your Email Address] to inform them of your decision.
  3. Packaging: Please carefully pack the items in their original packaging or in suitable packaging to ensure their protection during transport.
  4. Shipping: Go to your nearest post office to ship the package. You can use Colissimo or any other delivery method of your choice.

ARTICLE 7: WARRANTIES AND AFTER-SALES SERVICE

7-1 GUARANTEES
In the event of a product defect during use, all HistoiresdeRoseau® products are covered by a legal guarantee of conformity (Articles L.217-4 to L.217-14 of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 to 1648 of the French Civil Code) under the conditions stipulated by law. Please note that these guarantees do not apply when the damage is due to one of the following causes:
- The natural wear and tear and aging of HistoiresdeRoseau® products,
- The use of unsuitable cleaning or maintenance products,
- Failure to comply with precautions, advice and instructions regarding the use, assembly, maintenance, storage, preservation or protection of products,
- Discoloration due to light, weathering, or time spent using
- The modification of the very structure of the product.

It is further noted that the Guarantees applied to HistoiresdeRoseau® products cannot cover use of the Product for professional or commercial purposes, nor can they cover unforeseen or inappropriate use of the product.

Finally, the guarantees only cover the right to repair, replacement, or refund of the guaranteed product. Consequently, they do not cover indirect damages.

7.2 After-Sales Service
HistoiresdeRoseau® Beyond the commercial or legal warranty, the Customer always has the option of contacting HistoiresdeRoseau® Customer Service for any questions regarding product use or maintenance. To access this service, the Customer should visit the HistoiresdeRoseau® website and complete the dedicated contact form, or contact Customer Service at +33 6 70 69 80 78, Monday to Friday, from 1 PM to 5 PM. If HistoiresdeRoseau® needs to return the merchandise, the customer must retain the original packaging for collection.


ARTICLE 8: LIABILITY

For all stages of access to the website, the ordering process, delivery, customer service, and after-sales services, HistoiresdeRoseau® is only bound by an obligation of means. Consequently, HistoiresdeRoseau® cannot be held liable for any inconvenience or damage inherent to the use of the internet, including service interruptions, external intrusions, or the presence of computer viruses, or for any event considered force majeure, in accordance with applicable law.
Furthermore, HistoiresdeRoseau® cannot be held responsible if the order does not come to fruition or if it is prevented from fulfilling any of its obligations due to force majeure as defined by case law, and in particular in the event of severe weather preventing the delivery of the order.


ARTICLE 9: ENTIRETY

In the event that any clause of this contract is declared null and void by a change in legislation, regulations or by a court decision, this shall in no way affect the validity and compliance with all other provisions of these General Terms and Conditions of Sale.


ARTICLE 10: DURATION

These Terms and Conditions apply for the entire duration that the services and products offered by HistoiresdeRoseau® are available online.


ARTICLE 11: EVIDENCE

Computerized records, stored in the computer systems of HistoiresdeRoseau® and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments made between the Parties.


ARTICLE 12:

PRESERVATION AND ARCHIVING OF TRANSACTIONS The archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with Article 1348 of the Civil Code.


ARTICLE 13: DISPUTES

These terms and conditions are governed by French law. In the event of a dispute between the parties, they will endeavor to resolve it amicably with the after-sales service. If an amicable agreement cannot be reached, the customer is informed, in accordance with Article L.211-3 of the French Consumer Code, that they have the option of contacting a mediator free of charge. This mediator is registered on the list of mediators established by the Consumer Mediation Evaluation and Control Commission pursuant to Article L.615-1 of the French Consumer Code, namely: the Consumer Mediation Center of Justice Conciliators. The Client remains free to accept or refuse mediation, and if mediation is used, each party is free to accept or refuse the solution proposed by the mediator. In the absence of an amicable agreement, recourse to mediation, or acceptance by the parties of the solution proposed by the mediator, the dispute will be brought before the court in accordance with the rules of ordinary law.

Where applicable, the competent courts are the French courts, subject to any mandatory legal provisions in force in the consumer's country that may require a different jurisdiction. HistoiresdeRoseau® informs you of the existence of the European online dispute resolution platform, designed to collect any complaints arising from online purchases made by European consumers and to forward them to the competent national mediators.
